Business and Professions Code Section 7520 et seq., workplace investigations for public and private employers may only be completed by a licensed private investigator, a licensed attorney acting in their capacity as an attorney, an internal employee, or other listed official. Such investigations can not be conducted by external human resources consultants without an attorney license. In order to avoid risks such as invalidation of the investigation and potential civil and criminal liabilities, it is important to ensure that all workplace investigations are conducted by authorized personnel.
